Colorado Family Law

Colorado is a “no-fault” divorce state, in which you need not show a specific reason for divorce, such as infidelity or domestic violence. Rather you need only show that the marriage is irretrievably broken under C.R.S. 14-10-106(1)(a)(II). A spouse can also obtain an annulment or legal separation. Once a divorce is granted, the parties can file separate tax returns and remarry.

The court uses several factors to determine the best interests of the child, including the child’s wishes, each parent’s wishes, the child’s relationship with each parent, a child’s adjustment levels, and the mental and physical health of the parties involved. Shared parenting time is preferred so that both parents have frequent and continuous contact with a child. Every aspect of the case, from child custody to spousal support, can influence the outcome in the others.
